NASHVILLE—A federal judge ruled on May 26 that Fresenius must now pay the U.S. government $82.6 million instead of the original $19.3 million penalty handed down last year for Medicare fraud, according to a report from the Tennessean.
“The ruling replaces a previous $19.3 million ruling against Fresenius last year that was mistakenly entered by Haynes based on a misunderstanding between the judge and the federal government, which joined the whistle-blower case three years ago,” according to the newspaper.
Fresenius spokeswoman Jane Kramer told the Tennessean that the company will appeal the ruling to the 6th U.S. Circuit Court of Appeals and ask that the case be remanded for a jury trial.
